Jamtab - Terms and Conditions

1. Acceptance of Terms

By accessing or using Jamtab, including the Jamtab website, mobile applications, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service, our Privacy Policy, and our Copyright / DMCA Policy. If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

Jamtab is an interactive music learning and creator platform. Through the Services, users may:

  • Create, edit, publish, and share music tablature and notation.
  • Create synchronization timing data that aligns tablature to a recording.
  • Publish original creator content, including instructional videos and lessons that the creator has produced.
  • Use playback, looping, tempo adjustment, practice, playalong, and other learning tools.
  • Participate in social and community features such as comments, likes, follows, creator channels, and subscriptions.

Features and functionality may change over time without notice.

3. Music Playback in the Jamtab Mobile Applications

In the Jamtab mobile applications, tablature is synchronized to music played back through third-party music services, using each listener's own account with those services:

  • Jamtab for iOS: playback is provided exclusively through Apple Music using Apple's MusicKit framework and the listener's own Apple Music subscription.
  • Jamtab for Android: playback is provided through the YouTube embedded player, served by YouTube.

Where playback is provided this way, audio is delivered by the third-party service under that service's own licenses and terms, and is subject to that service's catalog, availability, regional licensing, and playback rules. Jamtab does not copy, store, cache, or redistribute content from these services. Album artwork and release metadata displayed within the Services are sourced from third-party music metadata providers and are used to identify recordings for the purpose of matching tablature to a track.

4. Eligibility

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Services. By using the Services, you represent and warrant that you meet these requirements and have the legal capacity to enter into these Terms.

If you are between the ages of 13 and the age of legal majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. A parent or guardian who permits a minor to use the Services agrees to be bound by these Terms with respect to that minor's use, and is responsible for the minor's activity, including any User Content the minor submits.

Use of Apple Music or YouTube playback within the Services is additionally subject to the age and account requirements of those services.

5. User Accounts

Certain features may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.

You agree to provide accurate information and keep your account information current.

6. User Content

"User Content" means content that users create, upload, publish, or otherwise make available through the Services, including tablature and notation, synchronization timing data, descriptive metadata, original creator videos and lessons, audio-visual recordings submitted through Jamtab's creator tools, comments, and profile information. User Content is stored and made available at the direction of the user who submits it.

Ownership of User Content

Users retain ownership of any intellectual property rights they hold in their User Content.

License Granted to Jamtab

By submitting, uploading, or publishing User Content through the Services, you grant Jamtab a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, perform, synchronize, adapt, modify, transcode, distribute, publish, promote, and otherwise use such User Content solely for the operation, improvement, promotion, and provision of the Services. This license extends to any recording, performance, composition, or other material embodied in your User Content, and continues for as long as that User Content remains on the Services.

User Representations

You represent and warrant that:

  • You own or possess the necessary rights, licenses, permissions, and authorizations to create, upload, and publish your User Content, including any recording, performance, or composition embodied in it.
  • Your User Content is your own original work, or you are otherwise authorized to publish it.
  • Your User Content does not violate applicable law or infringe the rights of any third party, including the rights of songwriters, music publishers, recording artists, record labels, and other rights holders.
  • You have the authority to grant the rights described in these Terms.

7. Copyright & DMCA Policy

Jamtab respects the intellectual property rights of others and expects users to do the same. Our full Copyright / DMCA Policy, including the requirements for a valid notice, the counter-notification process, and our repeat infringer policy, is available at Copyright / DMCA Policy.

Notices of claimed copyright infringement should be sent to our Designated Copyright Agent, whose full contact information is published in that policy. Jamtab will act expeditiously to remove or disable access to material that is the subject of a valid notice, and terminates the accounts of repeat infringers in accordance with that policy.

8. Prohibited Conduct

You agree not to:

  • Violate applicable laws or regulations.
  • Infringe or violate intellectual property or other rights.
  • Upload malicious code, spam, malware, or harmful content.
  • Harass, threaten, impersonate, or abuse others.
  • Attempt to interfere with the operation or security of the Services.
  • Access the Services using unauthorized automated means.
  • Use the Services in a manner that could damage, disable, overburden, or impair Jamtab systems.
  • Attempt to download, capture, record, or redistribute audio or video delivered through a third-party music service, or otherwise circumvent that service's protections or terms.

9. Third-Party Services & External Media

The Services integrate with, embed, reference, or link to third-party services, media providers, platforms, and websites, including Apple Music and YouTube.

Jamtab does not control and is not responsible for third-party content, availability, policies, or practices. Your use of those services is governed by their own terms and privacy policies, including the Apple Media Services Terms and Conditions and the YouTube Terms of Service, as applicable. You are responsible for maintaining any account or subscription required to use them.

10. Moderation & Enforcement

Jamtab reserves the right, but is not obligated, to review, monitor, moderate, remove, disable, restrict, or terminate access to any content, account, or activity at its discretion and without notice, including where Jamtab believes conduct may violate these Terms, applicable law, or the safety or integrity of the platform.

11. Monetization & Creator Features

Jamtab may offer creator monetization features, subscriptions, promotional opportunities, or revenue-sharing programs now or in the future.

Eligibility, availability, payout structures, and participation requirements may change at any time.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

JAMTAB DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.

Jamtab does not guarantee that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any particular recording will be available for playback.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAMTAB, ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICES.

14. Indemnification

You agree to defend, indemnify, and hold harmless Jamtab, its affiliates, officers, employees, contractors, and partners from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from:

  • Your use of the Services.
  • Your User Content.
  • Your violation of these Terms.
  • Your violation of applicable law or third-party rights.

15. Termination

Jamtab may suspend or terminate access to the Services at any time and for any reason, including violations of these Terms.

16. Changes to Terms

Jamtab may update these Terms periodically. Updated versions will be posted within the Services with a revised "Last Updated" date.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

17. Dispute Resolution; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Informal Resolution

Before initiating any arbitration or proceeding, you agree to first contact Jamtab at admin@jamtab.com and provide a written description of the dispute and your contact information. The parties will attempt in good faith to resolve the dispute informally for at least thirty (30) days from the date of notice.

Agreement to Arbitrate

If the dispute is not resolved informally, you and Jamtab agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration shall take place in Rutherford County, Tennessee, or may be conducted by telephone, video, or written submissions at the arbitrator's discretion. This agreement to arbitrate is governed by the Federal Arbitration Act.

Class Action Waiver

YOU AND JAMTAB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.

Right to Opt Out

You may opt out of this arbitration agreement by sending written notice to admin@jamtab.com within thirty (30) days of first accepting these Terms. Your notice must include your name, the email associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, the Governing Law and Venue section below will govern any disputes.

Severability of this Section

If the Class Action Waiver is found unenforceable as to a particular claim, that claim shall be severed and proceed in court, while the remainder of this section continues to apply to all other claims.

18. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict-of-law principles. You agree that the exclusive venue for any dispute arising out of or relating to these Terms or the Services shall be the state or federal courts located in Rutherford County, Tennessee, and you consent to the personal jurisdiction of those courts.

19. Severability

If any provision of these Terms is held invalid, unlawful, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, severed from these Terms. The remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy, the Copyright / DMCA Policy, and any additional terms applicable to specific features, constitute the entire agreement between you and Jamtab regarding the Services and supersede all prior or contemporaneous understandings, agreements, or representations, whether written or oral.

21. Assignment

You may not assign or transfer these Terms, or any rights or obligations under them, without Jamtab's prior written consent. Jamtab may freely assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets. These Terms bind and inure to the benefit of the parties and their permitted successors and assigns.

22. No Waiver

Jamtab's failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or of the right to enforce it. No waiver shall be effective unless in writing and signed by an authorized representative of Jamtab.
