1. Copyright Policy
Jamtab, LLC ("Jamtab", "we", "us", or "our") respects the intellectual property rights of others
and expects users of the Jamtab website, mobile applications, and related services (collectively, the "Services")
to do the same.
This policy explains what content exists on the Services, how music playback works in the Jamtab
mobile applications, and how copyright owners may submit notices of claimed infringement under the
Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.
2. What Users Create on Jamtab
Jamtab is a creator and community platform. Registered users create, upload, and publish
tablature and notation, synchronization timing data, descriptive metadata, comments, creator
profiles, and audio-visual recordings submitted through Jamtab's creator tools
(collectively, "User Content"). User Content is stored and made available at the direction
of the user who submits it.
Users are responsible for ensuring that they hold all rights, licenses, permissions, and authorizations
necessary for any User Content they create or make available through the Services — including any
recording, performance, composition, or other material embodied in it — and for ensuring that
their User Content does not infringe the rights of any third party.
3. Music Playback in the Jamtab Mobile Applications
In the Jamtab mobile applications, tablature is synchronized to music that is played back through
third-party music services, using each listener's own account with those services:
-
Jamtab for iOS: playback is provided exclusively through
Apple Music using Apple's MusicKit framework and the listener's own
Apple Music subscription.
-
Jamtab for Android: playback is provided through the
YouTube embedded player, served by YouTube.
Where playback is provided this way, the audio is delivered by the third-party service under
that service's own licenses and terms, and is subject to that service's catalog, regional
availability, and playback rules. Jamtab does not receive, copy, store, cache, or redistribute
audio delivered by those services.
Album artwork and release metadata displayed within the Services are sourced from third-party music
metadata providers and are used to identify recordings for the purpose of matching tablature to a track.
Jamtab removes or disables access to media in response to valid notices of claimed infringement
as described in Sections 5 through 7, and may remove or restrict media at any time where rights
cannot be verified.

5. Reporting Claimed Copyright Infringement
If you believe that content available through the Services infringes a copyright you own or are
authorized to represent, you may send a written notice to our Designated Copyright Agent above.
To be effective under 17 U.S.C. § 512(c)(3), your notice must include substantially all of
the following:
-
A physical or electronic signature of a person authorized to act on behalf of the owner of an
exclusive right that is allegedly infringed.
-
Identification of the copyrighted work claimed to have been infringed, or, if multiple works
at a single site are covered by a single notice, a representative list of those works.
-
Identification of the material that is claimed to be infringing and that is to be removed or
access to which is to be disabled, and information reasonably sufficient to permit us to locate
the material — ideally the full URL of the specific page on Jamtab.
-
Information reasonably sufficient to permit us to contact you, such as your address, telephone
number, and email address.
-
A statement that you have a good faith belief that use of the material in the manner complained
of is not authorized by the copyright owner, its agent, or the law.
-
A statement that the information in the notification is accurate, and
under penalty of perjury, that you are authorized to act on behalf of the owner
of an exclusive right that is allegedly infringed.
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is
infringing may be liable for damages, including costs and attorneys' fees.
6. Our Response to Notices
Upon receipt of a notice that substantially complies with the requirements above, Jamtab will act
expeditiously to remove or disable access to the material claimed to be infringing.
We will make a reasonable effort to notify the user who published the material, provide that user
with a copy of the notice, and inform them of their right to submit a counter-notification.
7. Counter-Notifications
If you believe your content was removed or disabled as a result of mistake or misidentification,
you may send a written counter-notification to our Designated Copyright Agent. To be effective under
17 U.S.C. § 512(g)(3), your counter-notification must include substantially all of the following:
- Your physical or electronic signature.
-
Identification of the material that has been removed or to which access has been disabled, and
the location at which the material appeared before it was removed or disabled.
-
A statement under penalty of perjury that you have a good faith belief that the
material was removed or disabled as a result of mistake or misidentification.
-
Your name, address, and telephone number, and a statement that you
consent to the jurisdiction of the Federal District Court for the judicial
district in which your address is located (or, if your address is outside the United States,
the judicial district in which Jamtab may be found), and that you
will accept service of process from the person who provided the original notice
or an agent of that person.
If we receive a valid counter-notification, we may forward it to the party who submitted the original
notice and inform that party that we may restore the removed material in 10 business days. Unless
that party notifies us that they have filed an action seeking a court order to restrain the allegedly
infringing activity, we may restore the material in not less than 10 and not more than 14 business days
following receipt of the counter-notification.
8. Repeat Infringer Policy
Jamtab has adopted and reasonably implements a policy of terminating, in appropriate circumstances,
the accounts of users who are repeat infringers.
A user receives a strike when content they published is removed in response to a valid notice of
claimed infringement that is not successfully rebutted by a counter-notification. Upon accumulating
three strikes, the user's account will be terminated and that user's remaining
content removed from the Services. Jamtab may also terminate an account immediately, without regard
to strike count, in cases of egregious or willful infringement.
9. No Legal Determination
Jamtab may remove or restrict content in response to copyright notices, legal concerns, platform policy
issues, or other operational reasons. Jamtab's action or inaction does not constitute a legal determination
regarding ownership, infringement, fair use, licensing, or any other legal issue.
10. No Guarantee of Content Availability
Jamtab does not guarantee the continued availability of any content, tablature, synchronization,
creator profile, account, or feature. Content may be removed, restricted, modified, or disabled at any time.
Availability of music playback is additionally subject to the terms, catalog, and regional licensing of
the third-party music services described in Section 3.
11. Changes to This Policy
Jamtab may update this Copyright / DMCA Policy periodically. Updated versions will be posted with a revised
"Last Updated" date.
